FOREWORD
The Section of Antitrust Law of the American Bar Association is
pleased to present to the antitrust community the fourth edition of a
comprehensive guide to the process and procedures of U.S. and foreign
merger review from a U.S. perspective. The goal of The Merger Rev iew
Process: A Step-by-Step Guide to U.S. and Foreign Merger Review is to
make the merger review process more comprehensible and accessible to
parties and their counsel, and thus to enable them to be more effective in
the review process. Importantly, this Handbook focuses on the strategic
decisions that parties and their counsel must makeatkey junctures in the
merger process.
The fourth edition: (1) updates the proced ures followed by the U.S.
federal agencies and the corresponding options available to parties;
(2) expands the discussion of the role of state Attorneys General, foreign
competition authorities, federal and state sectoral regulators, the
executive branch, and national security agencies; and (3) includes new
chapters on second request production in the electronic age, preliminary
injunction litigation, administrative challenges, and the role of
economists before the agencies and in court. We are deeply indebted to
many private and government attorneys who contributed their time and
talents to the creation of this Practice Guide. Special thanksgotoformer

Practice Guide and coordinated the drafting of its many contributors.
