§ 31.8 EXECUTION UPON FORCIBLE-ENTRY-AND-DETAINER JUDGMENT

§ 31.8-1 Notice of Restitution

ORS 105.151 regulates a plaintiff's enforcement of a judgment of restitution. The first step after entry of judgment is a notice of restitution. This is issued by the court clerk and served on the defendant by being posted on the main entrance of the premises. The notice of restitution "shall give the defendant four days to move out of the premises, including removal of all personal property." ORS 105.151(1)(a).

§ 31.8-2 Writ of Execution

ORS 105.151(1)(b) specifies that after the four-day timeframe of the notice of restitution (see § 31.8-1), the court clerk must issue a writ of execution. The writ directs "the sheriff to enforce the judgment by removing the defendant and by returning possession of the premises to the plaintiff, along with an eviction trespass notice from the sheriff."
