§ 31.11 APPEAL AND REVIEW

As with any other civil case, ORS 19.255(1) specifies that "a notice of appeal must be served and filed within 30 days after the judgment appealed from is entered in the register." Failure to properly file and serve the notice of appeal will forever waive the losing party's right to appeal. Matters relating to appeals are beyond the scope of this chapter. However, it is critical to make a proper record at trial.

An appeal does not become moot if the tenant vacates while the appeal is pending. See Pendergrass v. Fagan, 218 Or App 533...
