Quick Checklist for Search Warrant Affidavit

•Caption. Have you included the proper title of the court

which will issue the warrant?

•Affiant. Have you described your training and experi-

ence and told the court about your prior search warrant

experience?

•Description. Have you particularly described the place

to be searched? Have you particularly described the per-

son or things to be seized? Have you discussed the curti-

lage and outbuildings?

•Probable cause. Have you given the court sufficient in-

formation to conclude that there is probable cause to

believe that fruits, instrumentalities or evidence of a crime

will be found?

•Notice. Will the warrant be served with notice, or is it a

no-knock warrant? Have you given the court reasons to

issue a no-knock warrant?

•Time. Is the warrant to be served at night? Have you

provided a justification for night time service?
