I am foremost grateful to my wife and her understanding of long hours
at the keyboard, highlighted case reports spread across the desk and
floor, and meals eaten while balanced over pages of notes. Thanks to
my children, at home and afar, for keeping me grounded in the impor-
tant stuff.
I am deeply indebted to a collection of fine prosecutors, civil
rights attorneys, and criminal defense attorneys who helped shape
this book into a usable reference work. Thanks to Kirk Torgensen, Loni
DeLand, Peter “Rocky” Rognlie, and Paul Amann for their enlighten-
ing comments and able critiques along the way. Lt. Ed Spann and Sgt.
Dave Hatch (Las Vegas Metro Police Department, retired) provided

appendix was written by Davis Wallentine, a soldier who exempli-
fies loyalty, duty, respect, selfless service, honor, integrity, and per-
sonal courage, and who is an outstanding son.
I am constantly humbled and sustained by the examples of crimi-
nal defense attorneys, prosecutors, judges, and public safety officers
who live and work in faithful obedience to the United States Consti-
tution. As the final pages of this book were written, my former stu-
dent, employee, and friend, Corporal Kevin Orr, joined those who
gave their lives in defense of what is right. All give some and some
give all. This book is dedicated to them.
