Plaintiff alleges:

Fort Rock Sanitary District is a sanitary district duly formed and authorized pursuant to the laws of the State of Oregon to provide sanitation facilities and services in Pacific County, Oregon.

The permanent and temporary easements described in Exhibit 1, attached hereto and by reference incorporated herein, are necessary for a public use for the location, construction, and maintenance of a sanitary sewer line and pumping station in connection with the sanitary sewage collection and disposal system and facilities of the Fort Rock Sanitary District. Before commencement of this action, plaintiff by resolution so declared.

Defendants John Fee and Ruth Fee, husband and wife, claim ownership of the real property described in Exhibit 1.

Defendant Golden West Federal Savings and Loan Association claims some right, title, or interest in and to the real property described in Exhibit 1 under and by virtue of a mortgage dated December 1, 1976, and recorded December 2, 1976, at Book 75, page 101, of the mortgage records of Pacific County, Oregon.

5.

The true value of the permanent and temporary easements sought to be appropriated by the plaintiff herein is the sum of $1,000.
