§ 20.15 • DILIGENCE

An element of the representative's duty of care and prudence is to act with diligence, which includes promptness. He or she will assemble promptly the decedent's books and records, including copies of tax returns, to determine what assets there are and where they are, and to secure the other information necessary for intelligently stepping into the decedent's shoes. He or she should be aware of a seldom-utilized, court-assisted discovery process in the probate court to locate assets and papers (see C.R.C.P. 26; C.R.S. § 15-12-723).
