JurisdictionColorado
§ 20.11 • INCOME

It is the duty of the representative to make the estate as productive of income as is reasonable, taking into consideration that his or her principal functions are to collect and conserve the estate, pay debts, and distribute what is left to those entitled thereto.22

It was held in another jurisdiction that a guardian who, for more than nine years, allowed funds not needed for current purposes to remain in a checking account, without receiving any interest, should be surcharged with the income he could have secured by a prudent investment. Gordon v. Brunson, 253 So.2d 183 (Ala. 1971).
