A book such as this requires the effort of many hands. The editors would like to
take this opportunity to thank the many people who contributed to both the First
and Second Editions of this work. Firstly, we would like to thank Chuck Modell,
who, as chair of the ABA Forum on Franchising’s 2004 Annual Meeting in
Vancouver, was instrumental in the creation of the Canadian intensive program
that originally gave rise to the First Edition. Steve Goldman, then chair of the
ABA Forum on Franchising, deserves much credit for being a champion in the
creation of this monograph to add to the series of already successful ABA pub-
lications.
The individual authors from both editions were all pressed into doing double
duty, if not more, in order to prepare chapters appropriate for publication in this
work. We thank each of them for their extraordinary efforts.
The Second Edition of this book has been in the making for some years. At
the time of the First Edition, in 2004, only two provinces in Canada had a fran-
chise law. As of today there are six. The problem in completing a Second Edi-
tion was that each time we thought we were finished, another province announced
plans to introduce a franchise law. So we got used to putting the project aside,
revising the book to make it current, and then having the situation repeat itself.
But enough is enough already! So we have now completed this Second Edition,
which is current up until April 2017 and incorporates the new franchise law in
the province of British Columbia. British Columbia is the sixth province to bring
in a franchise law, alongside those that now exist in Alberta, Manitoba, New
Brunswick, Ontario and Prince Edward Island. As of this writing, no other un-
regulated provinces have indicated any plans to bring in a franchise law.
Thank you to the members of the ABA Forum for their patience in awaiting
this Second Edition. And a similar thank you to the lawyers on the ABA Forum’s
Publications Committee who have worked with us patiently over the last few
years, and in particular Rebekah Prince, our immediate liaison, and Jim Goniea,
current Chair of the ABA Forum’s Publications Committee, and John Baer (whom
we miss dearly) and Kathy Kotel, who assisted us with the First Edition. As well,
we would like to thank the lawyers and staff within our respective firms who
supported and assisted us on this project.
Finally, and especially, we need to thank our families for continuing to put
up with us, and our commitments at work, year after year. For Peter, this means
thanking my wife, Cari, who was pregnant with our first child when the First
Edition was being published. Our son Taylor arrived just in time for the 2004
