3. Pretrial Orders
The court’s pretrial orders that include only items on procedure go in the Pretrial Orders
tabbed section of the notebook. Pretrial orders that decide substantive issues (e.g., a sum-
mary judgment motion) belong in the “Motions; Orders” section.
Pretrial orders on procedure are orders that you need instant access to at pretrial
motions and at trial. This is a separate tab because of the need to have quick access.
Wherever you are, flip open the trial notebook, and quickly read the judge’s orders of
limitation that are as effective in your trial as a statute of limitations.
This is the place for the full text of any pretrial orders on procedure, even if you had noted
some or part of the orders in the Plan section as part of your discovery or trial plan.
