The SSA May Not Take Administrative Notice of VE Testimony From Other Hearings
Can an ALJ take notice of testimony of a VE given in one hearing and use that testimony at another hear-
ing? No, because such testimony is not presumed valid or reliable. On May 16, 2009, the ODAR Off‌ice of
the Chief Judge issued a bulletin (CJB) making clear that a VE’s response in one case, even in the form of a
written interrogatory, cannot be presumed valid or reliable in another case.
