MOTION TO EXCUSE DISABLED JUROR

TO THE HONORABLE JUDGE OF SAID COURT:

COMES NOW the Defendant in the above entitled and numbered cause, by and through his attorney of record, (name of the Defendant’s attorney of record), and respectfully moves this Honorable Court to excuse a juror who has become disabled and can no longer serve in this case; and in support thereof would show the Court as follows:

I.

A jury has been selected for the trial of the instant case. A member of the jury has become disabled and can no longer serve in this case.

II.

Juror Number (number of disabled juror), (name of disabled juror) has become disabled and cannot further serve as a juror for the following reason: (the juror has become ill; or has become mentally unfit; or has become emotionally unfit; -or the juror has been injured; or the juror has suffered a death in the family; or has become unable to concentrate on the trial; or has been unable to find childcare).
