FOREWORD
The American Bar Association Section of Antitrust Law is pleased to
publish this DOJ Civil Antitrust Practice and Procedure Manual, a
comprehensive guide to the process and procedures governing antitrust
enforcement and policy making by the Antitrust Division of the U.S.
Department of Justice.
This Manual is intended to provide practical guidance to lawyers and
parties that are involved in antitrust matters, investigations, and litigation
with the Antitrust Division. Over the last several years, the Antitrust
Division has commenced a number of important antitrust enforcement
actions in the merger and non-merger fields. At the same time, it issued
policy statements and guidance to the bar and business community on
various aspects of antitrust law, both in the U.S. and abroad. This book
provides a framework for understanding the process and procedures the
Antitrust Division employs in conducting its investigations, reaching its
decisions about civil enforcement, advocating for competition, and
formulating guidance to the antitrust community.
The Section is grateful to the Manual’s editor, Kenneth M. Vorrasi,
and his team of contributing authors, each of whom dedicated countless
hours to the preparation of the book. We also thank the Co-Chairs of the
Federal Civil Enforcement Committee, M. Howard Morse, who
conceived of the project and oversaw its progress, and Hill B. Wellford,
who provided helpful comments.
We trust that the Manual will serve as a helpful guide to those who
practice before the Antitrust Division and are involved in matters within
the jurisdiction of the Antitrust Division.
