§ 9.8 • ACTIONS BY FOREIGN REPRESENTATIVES

As an alternative to the full ancillary probate and appointment proceedings described above in § 9.4, foreign representatives who have filed in any county in this state authenticated copies of their letters and bond in the foreign jurisdiction may sue with respect to the decedent's estate, subject to any restrictions on nonresidents generally.43 A foreign representative may be sued in the courts of this state with respect to estate matters and an adjudication for or against a personal representative in any jurisdiction is binding on the local representative as though he or she were a party.44 The statute has been updated, and the procedure, under current probate rules and forms, is discussed in Wade, Colorado Probate System, Special Instruction 28b.45
