The undersigned, being of lawful age, states as follows:

1 . I am the attorney for the Plaintiff in the above entitled action.

2. Upon information and belief, Defendants Rose Kincade, a/k/a Rose B. Kincade, and Kurt Kincade are both now and were in the preceding three months in fulltime civilian pursuits and are not now nor were in the preceding three months in military service within the meaning of the Servicemembers Civil Relief Act of 2003, as evidenced by the Certificates attached as Exhibit "A".
