§ 12.13 • POST-DECREE

A suggested follow-up after the Decree has been recorded is an examination of the real estate index in the Office of the County Clerk and Recorder. Each defendant should be indexed as a grantor and each plaintiff should be indexed as a grantee, unless the quiet title action is a counterclaim, in which case the reverse is true.

After the Decree has been recorded, it would be appropriate to obtain a title insurance policy or a final attorney's opinion. The title company or opining attorney will normally include an exception that title will not be merchantable (1) until 182 days after the Decree was entered because of the possibility of relief under C.R.C.P. 60(b) for any defendant not personally served (see...
