§26.3 CONSOLIDATION OF CASES

RAP 3.3(a) provides that if two cases are tried together, the cases are consolidated on review. Cases consolidated by trial court order remain consolidated on review also. Moreover, RAP 5.3(e) provides that if cases have been tried together, even though not consolidated for trial, counsel may file just one notice of appeal.

Practice Tip: Counsel should be careful to include the appropriate information for all of the cases in the notice of appeal See RAP 5.3(a). See also §5.4(5) of this deskbook.

Cases consolidated for review in the Court of Appeals remain consolidated for review in the Supreme Court unless the Supreme Court orders to the contrary. RAP 3.3(b).
