Acknowledgments

Among members of the Book Publications Board of the ABA’s Section of

Environment, Energy, and Resources, this type of book is known as a “multi-

author chapter book.” On its face, that term discloses that most of the “heavy

lifting” for this book was provided by the chapter authors, not the editor who

asked them to contribute. I appreciate that all of the authors devoted a signifi-

cant amount of time to this effort, even when the demands on their time for

client work, teaching, and family may have been in conflict. Each of the

chapters also received valuable peer review, often by other members of the

Book Publications Board (or their co-workers). I thank the peer reviewers

for their valuable contribution.

What is less apparent from the term “multi-author chapter book” is how

difficult it is to align 20 authors on approximately the same schedule, to

avoid substantive duplication across chapters, and to achieve reasonable con-

sistencies of tone and format. For her invaluable assistance in this task, I wish

to thank Margrethe Kearney, my colleague in the Environment, Land & Re-

sources Department at Latham & Watkins LLP.

Separately, I would like to thank my partners at Latham & Watkins LLP,

who offered their encouragement, agreed to write two chapters of the book,

and provided peer review for two additional chapters. I am fortunate to prac-

tice environmental law at a firm where there is so much expertise to draw

upon, and where people are so gracious about sharing their time.

Of course, I owe special thanks to my wonderful wife, Beth, and my son,

Seth, for their encouragement and for tolerating my additional time away

from home for “work that is not billable!?” Last, but not least, I want to

thank my daughter, Hannah, for her tireless efforts designing ever-more-

complex cover designs for this book. It is a shame that neither the budget nor

the imagination of the marketing department at the ABA stacks up to the

vision of a 10-year-old with magic markers, a “green” ethic, and plenty of

time on her hands.
