STIPULATED AGREEMENT FOR RELIEF FROM AUTOMATIC STAY

The undersigned debtors, Bankruptcy Trustee, and creditor, hereby stipulate and agree to relief from the automatic stay issued in the above captioned case as follows:

WHEREAS, [plaintiff] is a creditor in the above captioned action by virtue of a tort action currently pending in the [location] Superior Court located in [county] County and known [case name and number]; and

WHEREAS, [carrier] Insurance Company issued to debtor [debtor] policy number [number], covering a [automobile year and model]; and

WHEREAS, the above policy was in effect on the date of [date] when [plaintiff] claims that [debtor] negligently caused him bodily injuries and damages; and

WHEREAS, said insurance policy carries the sum of $100,000 liability coverage for any damages which [carrier] Insurance Company may become obligated to pay [plaintiff] by virtue of the aforesaid tort action in [location] County Superior Court; and

WHEREAS, [carrier] Insurance Company is bound by the terms of the aforesaid insurance policy to pay all costs of defense in the aforesaid state court tort action;
