Baseball on Trial: The Origin of Baseball’s Antitrust Exemption.By

Grow covers the controversial 1922 Supreme Court ruling that held that the “business of
base ball”was not subject to the Sherman Antitrust Act because it did not constitute
interstate commerce. He presents a fresh look at the decision and its aftermath, which
lives on in Major League Baseball’s exemption from antitrust law. He argues that the
decision was in fact correct, given the circumstances of the time. Using recently released
documents from the National Baseball Hall of Fame, Grow charts how the Supreme
Court reached this unexpected result. While interstate commerce is widely regarded as an
exchange of tangible goods, baseball teams in the 1910s offered “entertainment”to their
fans. He concludes that despite the frequent criticism of the opinion, the court’s decision
was consistent with not only the legal climate of the early twentieth century but also the
needs of society.
