FOREWORD

The Section of Antitrust Law of the American Bar Association is

pleased to publish this volume of Frequently Asked Antitrust Questions.

This volume of Frequently Asked Antitrust Questions addresses a wide

range of issues that lawyers, particularly in-house corporate counsel, face

frequently. The publication also includes a resource at the end of each

chapter for those looking for a more in-depth treatment of the covered

subjects. Obviously, Frequently Asked Antitrust Questions is not a

substitute for competent legal advice, but we hope that it will provide a

quick introduction to the types of factors that in-house counsel need to

consider when confronting antitrust issues in their daily practice.

Frequently Asked Antitrust Questions has been a publication that has

been discussed for many years within the Section. It is the type of

publication that we believe will be an essential part of any in-house

counsel’s antitrust library. I want to commend the current leadership of

the Section’s Corporate Counseling Committee for ensuring that this

publication has been completed, but I also want to acknowledge the work

of the immediate past co-chairs of the Committee, Alan Silverstein and

Marcy Wilkov, for leading the effort to make this publication a reality.

This was not an easy publication to prepare. I want to give particular

thanks to Steven J. Cernak, Milton A. Marquis, and Michael B. Miller

for their hard work in overseeing the team that did the actual drafting.

The Section appreciates the experience, expertise, and effort that created

this publication.

The Corporate Counseling Committee is one of the most active

committees within the Section. It produces a large number of programs,

newsletters, brown bag sessions, and listserv discussions. If you are not

already a member of the Committee, I urge you to consider joining and

becoming involved.
