FOREWORD
This second edition of the Antitrust Evidence Handbook was prepared by
the Civil Practice and Procedure Committee of the Antitrust Section of
the American Bar Association as a reference guide for lawyers involved
in antitrust litigation. It updates the first edition, published in 1991, with
the many legal developments occurring since then. While antitrust
litigation is like other litigation in many ways, it is also unique in other
ways. This Handbook is intended to provide practitioners with a quick
reference source on evidentiary issues that arise principally, although not
exclusively, in antitrust cases. It is intended to supplement rather than
replace traditional evidence research tools. It is organized in outline form
so topics can be located quickly and easily. It is being published in a
format that easily can be carried by counsel to court or depositions. The
Antitrust Section hopes that anyone involved in antitrust litigation will
continue to find the Handbook to be a useful reference tool.
The principal editor and project leader for the second edition was Civil
Practice and Procedure Committee co-chair Edward D. Cavanagh, with a
substantial contribution from co-chair Donn P. Pickett, and members of
the Committee. The Antitrust Section is grateful and appreciative of their
efforts. It also is appropriate to recognize Janet L. McDavid, the principal
author of the first edition, and Carl L. Steinhouse and Sarah S. Vance,
who made substantial contributions.
