FOREWORD
The American Bar Association Section of Antitrust Law is pleased to
publish this second edition of the DOJ Civil Antitrust Practice and
Procedure Manual, a comprehensive guide to the process and procedures
governing antitrust enforcement and policymaking by the Antitrust
Division of the U.S. Department of Justice.
The Manual provides a framework for understanding the process and
procedures the Antitrust Division employs in conducting investigations,
reaching decisions about civil enforcement, advocating for competition,
and formulating guidance to the antitrust community. It offers practical
guidance to lawyers and parties involved in antitrust matters,
investigations, and litigation with the Antitrust Division. This second
edition of the Manual is updated to reflect current Antitrust Division
policies and practices as well as developments in case law; chapters have
also been edited and reorganized to promote readability.
The Section is grat eful to the Manual’s editors, Randall Weinsten
and Shylah Alfonso, and their team of contributing editors and authors,
each of whom dedicated countless hours to the preparation of this book.
We trust that the Manual will serve as a helpful guide to those who
practice before the Antitrust Division and are involved in matters within
the jurisdiction of the Antitrust Division.
