DOL continues to pursue misclassification.

The U.S. Department of Labor has taken a more pro-employer stance under the Trump administration. But as recent enforcement actions show, the DOL is still aggressively going after employers that misclassify their employees as independent contractors, even in industries where it is common to hire workers as independent contractors.

Recent case: A Michigan landscaping company classified all of its 32 workers as independent contractors. The DOL sued, saying they should really be employees and due overtime pay because the company supplied training, equipment, uniforms and schedules--and it controlled where and when they worked.
