§ 6.2 SALE OF PROPERTY — OVERVIEW

The sale of a property after a successful mechanics' lien lawsuit can be a detailed and complex undertaking. The following sections cover the basics of the sheriff's sale. For a much more detailed discussion and additional forms, see Colorado Real Estate Practice, 2017 Ed. (Deanne Stodden ed., CLE in Colo., Inc. 2017).

Once a lien claimant has received a judgment on a mechanics' lien foreclosure claim, either by default judgment or decision of the trial court, the next step is to sell the property to satisfy the judgment.

C.R.S. § 38-22-114(1) states how the sale of the foreclosed property in a mechanics' lien action may occur:

The court shall cause said property to be sold in satisfaction of said liens and costs of suit as in case of foreclosure of mortgages; and any party in whose favor a judgment for a lien is rendered, may
