§49.3HISTORICAL DEVELOPMENT

CR 49 became effective on July 1,1967. Modeled after Fed. R. Civ. P. 49, CR 49 adopted the federal policy of encouraging the use of special verdicts to promote judicial economy and to allow the court to exercise greater control over the jury.

CR 49 was amended in September 2001 to add CR 49(1), the "any juror" rule, to avoid hung juries and increase the number of jury verdicts.
