§ 19.1 • INTRODUCTION

Earlier chapters have discussed the role of courts in the arbitration process — staying or compelling arbitration; appointing the arbitrator; enforcing subpoenas; vacating, modifying, and correcting awards — as well as the role of the arbitrator. This chapter discusses the subject matter jurisdiction of the courts to undertake its roles and the in personam jurisdiction of the courts and the arbitrator over the parties.

The principal areas in which the courts become involved are:

• Motion to compel arbitration (and stay litigation);
• Motion to stay arbitration;
