➢ Evidence of Offer to Pay Medical Expenses. Evidence of a defendant's promise to pay a plaintiff's medical expenses may not be admitted to establish a defendant's liability. Pennington v. Sears, Roebuck & Co., 878 P.2d 152 (Colo. App. 1994); CRE 409.
