§ 10.2 CIRCUMSTANTIAL EVIDENCE

➢ General. "It is well established that there is no qualitative difference between direct and circumstantial evidence." People in Interest of M.S.H., 656 P.2d 1294, 1296 (Colo. 1983).

➢ Effect of Circumstantial Evidence. In negligence cases, circumstantial evidence may prove negligent conduct since proximate cause need not be proved by direct evidence. Holmes v. Gamble, 655 P.2d 405, 408 (Colo. 1982); Minto v. Sprague, 124 P.3d 881, 886-87 (Colo. App. 2005).
