1. The Alabama’s ban on same sex marriages was declared unconstitutional on January
23, 2015. See: Searcy v. Strange, 2015 WL 328825 (S.D. Ala. 2015)
2. A C. Art. 1, § 25 and A S. § 25.05.011, et seq. were declared
unconstitutional by the U.S. District Court in Hamby v. Parnell, ___ F.Supp.3d ___, 2014 WL
5089399 (D. Alaska 2014)
3. The court in Majors v. Horne, 14 F.Supp.3d 1313 (D. Ariz. 2014) declared A. R.
S. § 25-101(c) and § 25-125 to be unconstitutional.
4. The Pulaski County, Arkansas Circuit Court in Case No. 60CV–13–2662 on May 9,
2014 entered an order that read in pertinent part as follows: “THIS COURT HEREBY FINDS
the Arkansas Constitutional and Legislative ban on same- sex marriage through Act 144 of
1997 and Amendment 83 is unconstitutional.” The case is on appeal to the Arkansas Supreme
Court. See: Smith v. Wright, Not Reported in S.W.3d, 2014 Ark. 222, 2014 WL 2021834 (2014)
5. C. C. art. 1, § 7.5 (Proposition 8 adopted 2008), declared unconstitutional by
Perry v. Schwarzenegger, 671 F.3d 1052 (9th Cir. 2012), aff’g 704 F. Supp. 2d 921 (N.D. Cal.
2010), reh. en banc den. 681 F.3d 1065 (9th Cir. 2012), cert. den., sub nom Hollingsworth v.
Perry, 133 S.Ct. 786, 184 L.Ed.2d 526 (2014); and C. F. C § 308.5, declared uncon-
stitutional by In re Marriage Cases, 43 Cal.4th 757, 183 P.3d 384, 76 Cal. Rptr. 3d 683 (2008).
C. F. C § 308(a) passed in 2009 declared that same-sex marriages legally entered
into on or before November 4, 2008, in other states or countries will be recognized as mar-
riages under California law. Same-sex marriages taking place in other states or countries after
November 4, 2008, will only be recognized as domestic partnerships.
