Introduction
In recent years, judicial involvement in public personnel management has in-
creased and become the subject of substantial controversy. Whereas a decade
ago texts on public personnel management rarely contained much information
on
the constitutional rights of public employees, today chapters on these rights
are common. Moreover, judicial doctrines have unfolded in such a fashion as
to make public personnel managers personally liable if they cause a breach of
public employees’ constitutional rights. Consequently, public personnel ad-
ministration is being &dquo;judicialized&dquo; to a remarkable extent.
This development raises several important issues: Can public managers manage
under these circumstances? What of efficiency and productivity? Accountability?
