Sample Letter: To Insurance Carrier Regarding Five and Ten- Year Medical Records Request

Dear Insurance Adjuster,

You have requested medical records of my client for the (5, 10) year period prior to the incident which is the subject of this claim. Therefore, you are requesting records from the date of (exactly ten years prior to the date of the incident). We are not adverse to you receiving such records. However, we wish to make it crystal clear that we want to receive the exact same records you receive within 14 days after you receive them. In other words, we do not want to have to wait several weeks or months before we receive the same records that you have obtained through our client’s medical authorization form.

We reserve the right to argue at any subsequent trial or arbitration proceeding that the failure to provide us with the same records you obtained through the use of our client’s medical authorization form within 14 days may result in your inability to use such records against our client in any manner.
