PREFACE
The FTC Practice and Procedure Manual, now in this second edition,
provides an essential “how to” guide for parties and their counsel
involved in matters before the Federal Trade Commission (FTC),
whether on the competition or consumer protection side of the agency.
This book’s primary focus is on procedural matters specific to the FTC,
rather than substantive analysis of particular areas of law (the latter being
covered in the ABA Section of Antitrust’s many area-specific
publications). This book sets forth the FTC's history; statutory authority
under many different applicable laws, with a focus on how Section 5 of
the FTC Act impacts the agency's competition and consumer protection
missions; organizational structure and basic regulations; procedures and
rules governing mergers and non-merger investigations; other rules
governing investigations more broadly, including confidentiality
protections; and procedures for “Part 3” adjudication, which is the FTC’s
administrative trial function.
This book is the product of many contributors. John Graubert served
as chair of the project, recruiting editors and authors and providing
significant editing of his own, and was assisted in this task by Don Clark.
Stephen Stack and Jonathan Lutinski guided the project for the Books &
Treatises Committee. The Antitrust Section would also like to thank the
