PREFACE
The Intellectual Property Committee of the Section of Antitrust Law
is pleased to present this long-awaited update on an important subject:
antitrust counterclaims and misuse defenses in patent and other
intellectual property litigation. As antitrust issues more than ever work
their way into court cases involving patents and other forms of
intellectual property, this handbook is meant to provide practitioners with
a useful guide to the difficult procedural and substantive challenges
presented by such litigation.
Numerous individuals contributed to making this book a reality. Co-
editors Fiona Schaeffer and Russ Wofford marshaled the work of
numerous volunteers, and worked tirelessly to see this project through to
completion. We are indebted to both of them for their leadership roles.
Lisa Bourque and Jennifer Brace deserve special mention for their
invaluable project management assistance. Former Committee Chair
Mark S. Popofsky went above and beyond the call of duty from the
beginning of the project through his review of portions of the manuscript
before publication. Sean P. Gates also provided important insights in the
early stages of planning this book. Tony Askew, Ron Davis, Carole
Handler, Ethan Horwitz, Alan Kusinitz, Benjamin Marks, Robert Skitol
and Alan Weinschel greatly improved early drafts with their editorial
