After intense lobbying efforts by The Ohio Society, the Ohio Department of Taxation (ODT) has issued guidance to resolve recent Ohio corporation franchise tax bills and assessments sent to CPAs and their S corporation clients that contain errors.

The notices had become a concern for members and their clients who were being incorrectly assessed penalties and interest of thousands of dollars for delinquent tax liability.

According to ODT, the delinquency program does not have the ability to differentiate between a C corporation filer and an S corporation filer. If an open period exists, the program will generate a notice. While this does not mean that an S corporation owes the tax attributable to a C corporation, it is an indication that ODT does not have the required informational return on file...
