FOREWORD
The Section of Antitrust Law of the American Bar Association is
pleased to publish the second edition of Frequently Asked Antitrust
Questions. In addition to updating the law since the 2004 edition, this
revision of Frequently Asked Antitrust Questions provides more in-depth
discussion than its predecessor. The second edition continues the
tradition of providing an easy to read, quick introduction to a wide
variety of competition issues that lawyers, particularly in-house
corporate counsel, face frequently.
The first edition of Frequently Asked Antitrust Questions was very
well received. Given the substantial changes to the law since 2004, such
as Twombly and Leegin, it became clear that a revision was required.
Although this is not one of the Section’s larger publications, it still
required substantial time and effort to complete. This edition of
Frequently Asked Antitrust Questions was shepherded to completion by
the current leadership of the Section’s Corporate Counseling Committee.
Particular thanks go to Eric J. Stock and Jerome A. Swindell for their
time and diligence in overseeing the team of volunteers that did the
actual drafting. The Section appreciates the experience, expertise and
effort that are required to bring superior publications to our membership
and we believe this publication will become a valuable resource for your
practice.
