Editors’ Acknowledgments
John B. Brew, Brandi B. Frederick, and Christopher H. Skinner, the editors
of this book, would like to thank the authors and editors of the first edition
of this book. We extend a special thanks to Michael Sherman, the lead edi-
tor and author for the first edition, whose vision, tireless efforts, and skill
made this book possible. As Michael was fond of saying, “the first draft is
always the hardest.” The hard work of the previous editors and authors
made our job much easier.
We would also like to extend a special thank you to Richard G. “Rick”
Paszkiet, Deputy Director, ABA Book Publishing, American Bar Associa-
tion, Kimberly Rosenfield, Executive Editor, ABA Book Publishing, Ameri-
can Bar Association, and everyone at the ABA who assisted them. Rick was
instrumental in the publishing of the first edition of this book, and moving
forward the publication of this much-needed second edition. Kimberly
capably took over the reins from Rick, and she and her ABA colleagues
provided invaluable support and effort to complete this project.
Finally, we would like to extend thanks to the authors and contribu-
tors. This book would not be possible but for their substantive expertise
and insight, and for that we are truly appreciative.

To my mom, Ann Dale Brew—your faith, love, and understanding endures.
I would also like to thank my family, Tracy, Grace Ann, Deacon, and
Baxter, for their understanding when I am not around and ability to deal
with me when I am. My family’s passion for matters both big and small has
provided me with some challenges, but greater rewards, for which I am
very fortunate and grateful. Their creativity also requires that I keep
improving my oral advocacy skills, even when I am not at work. I also
would like to thank my firm Crowell & Moring, and its professional staff.
Crowell was beyond supportive, not questioning the time needed to com-
plete this project, and providing the encouragement to do it well. Thanks
