PRACTICE NOTE
Although the Texas Legislature recently enacted a major reform of the Texas Workers’ Compensation Act,
effective September 2005, no changes were made to Chapter 451. House Bill 7 (HB7) is designed to reduce
costs, improve medical care, and improve the rate and speed with which injured employees to return to work.

PRACTICE NOTE
The 2005 reform of the Texas Workers’ Compensation Act also eliminates the six-member Texas Workers’
Compensation Commission. Its functions will be turned over to the newly-created Division of Workers’
Compensation within the Texas Department of Insurance. This new Division will be run by a single guber-
natorial appointee, the Commissioner of Workers’ Compensation. It is hoped that much of the bureaucratic
in-f‌ighting will be eliminated by having a single individual serve as the point person over the workers’
compensation process.
