§ 5.19 • UNITS: UPKEEP AND ACCESS

Generally, a unit owner is charged by statute with responsibility for maintenance, repair, and replacement of his or her unit, while the association is responsible for maintenance, repair, and replacement of the common elements.303

So that the various responsibilities for maintenance, repair, and replacement may be performed, each unit owner is required to afford access to his or her unit to the association and to other unit owners as well as to their agents or employees as is reasonably necessary for those purposes.304 If, however, a unit owner inflicts damage on either the common elements or on any unit through which access is taken, that unit owner is responsible for the damage. And if a strong likelihood exists that damage will be inflicted by a unit owner, that unit owner is responsible for the expense to avoid the damage.
