§42.3HISTORICAL DEVELOPMENT
CR 42 was adopted in 1967 and is virtually identical to Fed. R. Civ. P. 42, which was adopted in 1966. Washington's Rule of Pleading Practice and Procedure (RPPP) 42(a) was substantially similar to the current CR 42(b), although it did not include the phrase "or when separate trials will be conducive to expedition and economy" or the proviso expressly protecting the right to a jury trial. CR 42 has never been amended.
