§ 34.5 • NEGLIGENT AND FRAUDULENT MISREPRESENTATION

In theory, a plaintiff could bring a claim for negligent35 or fraudulent36 misrepresentation in the products liability context.37 However, such claims would require the plaintiff to meet a higher burden of proof, and he or she would not recover any more in damages than under a strict liability misrepresentation claim.
