§28.3HISTORICAL DEVELOPMENT
CR 28 was enacted on May 5, 1967, and became effective on July 1, 1967. Previously, out-of-state depositions were addressed by former RCW 5.16.010 and .020 (repealed 1957) and Rule of Pleading Practice and Procedure (RPPP) 28.
CR 28 was amended effective September 1, 1985. The 1985 amendments added "letters of request" to CR 28(b)(3) and authorized depositions pursuant to treaties and conventions. The 1985 amendment specifically recognized the taking of depositions abroad pursuant to the Hague Convention on The Taking of Evidence Abroad in Civil or Commercial Matters, Oct. 7, 1972, 23 U.S.T 2555...
