§22.1 INTRODUCTION

Interpleader is a remedy designed to protect the holder of an asset (a stakeholder) from the possibility of double or multiple judgments when two or more parties claim a right to the asset. Interpleader is commonly sought by garnishees in possession of funds to which multiple creditors lay claim, escrow holders, insurance companies, banks, or any parties who have acknowledged obligations with more than one claimant and have expressed some uncertainty as to the proper legal title or ownership.
