21-3 Subject Matter Jurisdiction for Counter, Cross, and Third-Party Claims

Counter, cross, and third-party claims may not exceed the maximum jurisdictional limits of the Texas justice, constitutional county, statutory probate, and statutory county courts.45 Where the claim exceeds the maximum jurisdictional limit of the court, the court is without jurisdiction over the claim.46 The claims of multiple cross, counter, and third-party claimants are not aggregated for purposes of determining if the amount in controversy exceeds the court's maximum jurisdictional limit.47 However, the claims of a single claimant are aggregated to determine the amount in con-troversy.48
