Chapter 18 - § 18.7 • ENFORCEMENT OF THE JUDGMENT

JurisdictionColorado
§ 18.7 • ENFORCEMENT OF THE JUDGMENT

Under the CRUAA, once the court has confirmed, modified, or corrected an award, the judge enters a judgment in conformity with the award. At that point, the award — now a judgment — is treated and enforced in the same way as any other judgment.89

Under FAA § 13, the judgment entered has the same force and effect in all respects as a judgment in any civil action and is subject to all the provisions of law relating to a judgment in any civil action, and it may be enforced as if it had been rendered in an action in the court in which it is rendered.90

Once the time for a motion to vacate has passed, the judgment debtor cannot use grounds for vacating an award as a defense to confirmation.91
