§ 17.16 • NOTICE OF CLAIMS

Many contracts and subcontracts provide for notices of claims for increased compensation or time extensions based upon conditions experienced in the field, such as the need for added work or conditions delaying a contractor's or subcontractor's progress. However, many of those provisions do not have sufficient requirements that the notices be given within a certain period of time; that they be sufficient to allow the party to whom notice is given to (1) investigate the claims, (2) take actions to possibly alleviate the situation giving rise to the claims, or (3) allow the party to whom notice is given an opportunity to, in turn, assert its corresponding claims against others (owners or other subcontractors or suppliers).

Accordingly, the following more-comprehensive notice-of-claim language is suggested:

In the event that Subcontractor desires to make a claim for additional time or compensation, if entitled to do so under this Subcontract, Subcontractor shall give written notice
