However, he said there weren’t any allegations that
the sheriff was aware of her suffering, and the mere
knowledge that an employee had a medical condition
was insufcient to demonstrate that the condition was
disabling as dened by the ADA.
The judge also ruled that an employer couldn’t be
guilty of disability discrimination if the employer was
unaware that the employee was claiming a disability.
The judge also agreed that the “medical docu-
mentation” provided by the plaintiff was inadequate
because it didn’t contain any details about: (1) her
condition, (2) the causes of her absence from work or
(3) her limitations as a result of her alleged disability.
EMPLOYER WINS Implicitly nding that
the alleged telephone calls were also inadequate and
vague, the judge said it was generally the responsi-
bility of the individual with a disability to inform
the employer that an accommodation was needed.
He dismissed the claim, ruling the plaintiff couldn’t
hold the sheriff liable for accommodations she never
requested.

Childhood cancer foundations
merge operations
Two leading organizations engaged in the ght
against childhood cancer have joined forces in an
effort to maximize their collective mission. The
Philadelphia, Pa.-based Alex's Lemonade Stand
Foundation and the Fort Lauderdale, Fla.-based
I Care I Cure Childhood Cancer Foundation have
merged their operations. The ALSF will assume
ICIC’s assets and will manage operations of the newly
combined entity, the groups said. The founders and
board members of ICIC will establish an advisory
board to continue their annual fundraising events
and programming.
Over the next few months, the ALSF will work with
ICIC to welcome its supporters and move forward
with their shared mission. Funds donated from the
new advisory board’s efforts will continue to support
less-toxic therapies for children with cancer through
the Alex’s Lemonade Stand Foundation grant giving
program.
According to ICIC co-founders Beth and Brad
Besner, both organizations, which were founded by
parents who suffered the loss of a child to cancer, have
a deep understanding of the needs for better treat-
ments and cures. The two entities have partnered in
the past to fund 24 mission-related research projects.

ve-year initiative aimed at supporting growth in un-
derserved communities and advancing socioeconomic
mobility by closing gaps in equity and opportunity.
The Capital One Impact Initiative is focused on creat-
ing a world where everyone has an equal opportunity
to prosper by advocating for an inclusive society,
building thriving communities and creating nancial
tools that enrich lives.
Key components of the initiative include investing
in diverse communities and businesses, and support-
ing organizations that expand economic opportunity,
particularly for Black and Latinx communities; pro-
viding capital to nance affordable rental housing
developments that meet the needs of a diverse range
of households and communities in partnership with
nonprot organizations, for-prot real-estate de-
velopers and government; accelerating investments
with Black and Latinx partners and suppliers and
expanding mentoring, training and advisory pro-
grams designed to help Black and Latinx businesses
and nonprots succeed; and expanding programs
that provide opportunities for individuals who face
impediments to unleash their potential and thrive in
a rapidly changing employment market.
