ABOUT THIS BOOK
        assisting claimants in
long term disability claims subject to ERISA. e book addresses the
full spectrum of ERISA long term disability claims. It begins with case
screening and intake, moves through each level of the administrative
process (i.e., claim ling, appeals, and protecting ongoing benets),
and then tackles the complex process of litigating these claims in federal
court. e book oers valuable insight and tips at each step.
In addition to providing a practical practice guide, this book also
provides an overview of the applicable procedural claims regulations
under ERISA. It oers strategies about how to maximize those require-
ments to your client’s advantage while also helping you to avoid traps
set by the insurer.
e book’s extensive appendix of sample practice forms, templates,
and communications makes it easy to apply the authors’ work to your
own practice. It even contains a sample complaint.
is book supplements and updates its predecessor, An Attorney’s Guide
to ERISA Disability Claims, which was written by Scott M. Riemer and pub-
lished by James Publishing in 2014. While the 2014 book oered extensive
information about the claims and administrative process, it did not address
the screening/intake process, how to eectively protect ongoing bene-
ts, or how to litigate these claims. is book also addresses signicant
changes in the law that have arisen since the prior book was published.
Most specically, the current book discusses the new claims regulations
adopted by the United States Department of Labor eective April 1, 2018.
e book is written to be of help to not only attorneys who represent
ERISA claimants, but also to ERISA claimants themselves. It is written
by NYC disability attorneys who have been through it all and wish to
share their knowledge and experience with others.
