§ 68.11 WHEN A LIFE INSURANCE POLICY IS SECURITY FOR A SUPPORT OBLIGATION

In obtaining procurement of a client's spousal maintenance or property distribution payment, it is wise to secure your client's interest by requiring the obligor spouse to maintain a life insurance policy naming your client as irrevocable beneficiary. For child support, it is important to require both parties to maintain a life insurance policy, regardless of with whom the children reside a majority of time or who has the obligation to pay child support, as both parties owe a duty to support their children.
