§ 59.11 REINSTATEMENT OF PARENTAL RIGHTS (RCW 13.34.215)

RCW 13.34.215 provides for reinstatement of parental rights in certain circumstances. This does not mean, however, that a child has a right to reinstatement of previously extinguished parental rights. In re Interest of J.R., 156 Wn. App. 9, 19, 230 P.3d 1087 (2010). This statute is a recognition that the situation of the parent and child changes after termination of parental rights and reunification may subsequently be appropriate. Reinstatement may be filed by the child in cases in which the child was found dependent, parental rights were involuntarily terminated, and at least three years have elapsed without a permanency plan being achieved.
